What does "essentially under Martial Law" mean? Is it the same as "mostly pregnant"?

I think it means that they only need an excuse to openly admit and carry it out. For example, if there was a "national emergency" it's already passed as law and deploying the national guard to US streets would only take a phone call. The ground work has already been laid.

The groundwork for martial law is long established and has been invoked in this country on several occasions. If the fear is the establishment of martial law nationwide, it would be quite a thing to see the Federal government attempt to enforce it.

I would also add that those of us who opposed the Patriot Act and called for restraint and reason in the wake of 9/11 knew that these were the types of moves available to any future president- not just Dubya- should the neo-cons and other unhinged hawks have their way. And 2/3's of the country called us traitors.

And notice, it was the liberals who were outraged by the patriot act and it's a liberal op-ed piece in the Huffington Post today. I'm sure the selective outrage of the right wing pundits will pick this up soon disregarding their past support of the Patriot Act.
Personally I don't distrust Obama but I don't think that much power should fall in any one mans hands whether it's Obama or a future president. God help us if someone like Santorum takes the throne.
